1. Use of this site constitutes your acceptance of these terms and conditions.

2. D C Thomson & Co Limited (“D C Thomson”) reserve the right to change these terms and conditions at any time by posting changes online. You are responsible for regularly reviewing information posted online to obtain timely notice of such changes. Your continued use of this site after changes are posted constitutes your acceptance of this agreement as modified by the posted changes.

3. The Products and Services Directory (“the Directory”) is published by D C Thomson. It is hosted by the internet service provider, Scotland On Line Limited, on behalf of D C Thomson.

Using the Directory

4. Merchandise, products or services may be provided to you by third parties through the Directory or links to third party websites on this website. Neither we nor any of our officers, directors, shareholders, employees, agents, affiliates or sponsors, licensors or the like, make or give any representation or warranty or condition, either express or implied, to you regarding any such merchandise, products or services nor the accuracy or completeness of any third party providers’ representations nor the legality, reliability, quality or suitability of any third party providers or their merchandise, products or services nor for any contracts entered into with any third party thereafter. You assume the entire risk of loss resulting from your use of the Directory.

5. While using the Directory, you may access third party website through links in the advertisements. Such third party websites are not within our control and we do not take responsibility for the availability of such sites or their contents. Any links provided, are provided for your interest or convenience only and do not represent or imply any endorsement by D C Thomson and we cannot be held liable for any loss or damage which may arise from the use of such third party website. The use of such third party websites are governed by the terms and conditions of use applicable to these sites.

6. The Directory may be interrupted from time to time when essential maintenance or other technology or servicing work requires to be undertaken. Given the nature of the Directory, D C Thomson cannot warrant that the Directory will be free from errors, defects or inconsistencies.

7. The reproduction, copying, downloading, storage, recording, broadcasting, publishing, retransmission and distribution of any part of the Directory is strictly prohibited except as specified by Clause 5 or where a browser on your personal computer saves pages and screens.

8. D C Thomson grants you a non-transferable, non-exclusive licence to use the Directory solely for internal use by your business or for your own personal use. You may make a single, hard copy printout of pages/screens from the Directory, the use of which is subject to the terms of this licence.

9. You may not in any way copy or modify any part of the Directory except as specified by clauses 4 & 5 above. You may not publish, sell, assign, sub-licence, market, develop or alter in any way any part of the Directory or use them in any manner not expressly authorised by this Agreement.

10. D C Thomson retains all ownership rights in the Directory. The Directory is copyrighted and may not be copied except as provided in this Agreement, even if modified or merged with other website not belonging to D C Thomson Limited.

Exclusion of liability

11. D C Thomson will not be liable for any damages, claim or loss whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or other delict action, arising out of or in connection with the use of the site, including, but without limitation to, compensatory, incidental, special, consequential damages, lost profits, lost sales or loss of business.

12. DC Thomson accept no responsibility in respect of losses or damages including those relating to reputation arising out of changes made to the content of this web site by any third parties.

13. Access to and use of this web site is at your own risk and we do not warrant that use of the web site or any material downloaded from it will not cause damage to any property or data, including but not limited to loss of use of data or equipment, loss of data or computer virus infection.

14. Nothing in these terms and conditions shall attempt to exclude liability for death or personal injury arising from our negligence or breach of duty or for fraudulent misrepresentations.

Severability

15. If any of these terms and conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms and conditions are determined to be effective, then to the extent and within the jurisdiction which that term or condition is illegal, invalid or unenforceable, it shall be severed and deleted from this contract and the remaining terms and conditions shall remain in full force and effect and will continue to be binding an enforceable.

Jurisdiction

16. These terms and conditions shall be governed by and construed in accordance with the laws of Scotland and will be subject to the prorogation of the Scottish courts.
