TERMS AND CONDITIONS OF USE OF SERVICE AND ADVERTISING IN THE DIRECTORY

1. Use of this site constitutes your acceptance of these terms and conditions.

2. D C Thomson & Co Limited (“D C Thomson”) reserve the right to change these terms and conditions at any time by posting changes online. You are responsible for regularly reviewing information posted online to obtain timely notice of such changes. Your continued use of this site after changes are posted constitutes your acceptance of this agreement as modified by the posted changes.

3. The Products and Services Directory (“the Directory”) is published by D C Thomson.

Advertising Products and Services in the Directory

4. In return for a fee which may be set by D C Thomson from time to time, you can provide the name, logo, and contact details of your business, approximately 100 words of text to describe the products and services that you provide and a direct link to your web site in the form of an advertisement which may be published in the Directory.

5. In placing an advertisement in the Directory, you agree not to post any material which is defamatory, offensive, obscene, in bad taste or inappropriate.

6. You also warrant that all information provided will be up to date and accurate and that you control all intellectual property rights relating to the material and grant D C Thomson a non-exclusive licence to use your intellectual property rights for the purposes of publishing the advertisement. You will further warrant that the information contained in the advertisement complies with all applicable laws, regulations, trading standards and codes of conduct applicable to your business including, without prejudice, the Data Protection Act 1998, Consumer Protection (Distance Selling) Regulations 2000, the Electronic Commerce (E C Directive) Regulations 2002 and the Committee of Advertising Practice (CAP) Code.

7. D C Thomson will use reasonable endeavours to reproduce the required information in accurate detail as provided by you but reserves the right to make changes, alterations or amendments as required to ensure that the advertisement is formatted in accordance with the Directory website.

8. Each advertisement will be published for a minimum of six weeks. There will be an opportunity within each six week period to update or make minor amendments to the advertisement. There will not normally be an additional fee for any such amendment.

Copyright

9. The reproduction, copying, downloading, storage, recording, broadcasting, publishing, retransmission and distribution of any part of the Directory is strictly prohibited except as specified by Clause 5 or where a browser on your personal computer saves pages and screens.

10. D C Thomson grants you a non-transferable, non-exclusive licence to use the Directory solely for internal use by your business or for your own personal use. You may make a single, hard copy printout of pages/screens from the Directory, the use of which is subject to the terms of this licence.

11. You may not in any way copy or modify any part of the Directory except as specified by clauses 4 & 5 above. You may not publish, sell, assign, sub-licence, market, develop or alter in any way any part of the Directory or use them in any manner not expressly authorised by this Agreement.

12. D C Thomson retains all ownership rights in the Directory. The Directory is copyrighted and may not be copied except as provided in this Agreement, even if modified or merged with other website not belonging to D C Thomson Limited.

Exclusion of Liability

13. D C Thomson will not be liable for any damages, claim or loss whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or other delict action, arising out of or in connection with the use of the site, including, but without limitation to, compensatory, incidental, special, consequential damages, lost profits, lost sales or loss of business.

14. DC Thomson accept no responsibility in respect of losses or damages including those relating to reputation arising out of changes made to the content of this web site by any third parties.

15. Access to and use of this web site is at your own risk and we do not warrant that use of the web site or any material downloaded from it will not cause damage to any property or data, including but not limited to loss of use of data or equipment, loss of data or computer virus infection.

16. Nothing in these terms and conditions shall attempt to exclude liability for death or personal injury arising from our negligence or breach of duty or for fraudulent misrepresentations.

Severability

17. If any of these terms and conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms and conditions are determined to be effective, then to the extent and within the jurisdiction which that term or condition is illegal, invalid or unenforceable, it shall be severed and deleted from this contract and the remaining terms and conditions shall remain in full force and effect and will continue to be binding an enforceable.

Jurisdiction

18. These terms and conditions shall be governed by and construed in accordance with the laws of Scotland and will be subject to the prorogation of the Scottish courts.
